DataKITE Terms of Use

1. Acceptance

By accessing or using DataKITE (our Software) as a Service (SaaS) platform (the “Platform”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the Platform.

2. License Grant

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Platform. You may not modify, distribute, or create derivative works based on the Platform.

3. User Data

You are responsible for all data uploaded or transmitted through the Platform (your “User Data”). You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Data to provide the Platform’s services.

4. Intellectual Property

The Platform, including its underlying technology, is our proprietary property. You may not use any of our trademarks or logos without our prior written consent.

5. Security

We take reasonable measures to protect the security of the Platform and your User Data. However, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials.

6. Termination

We may terminate your access to the Platform at any time for any reason. Upon termination, you will no longer have access to the Platform or your User Data.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.  

8. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PLATFORM.  

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the United Kingdom.  

10. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting a revised version on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
